These Terms & Conditions ("Terms") govern your use of the KS Loans website, WhatsApp application channel, and Client Portal (together, "the Services"), and your relationship with us as a credit provider. By applying for credit, creating a Client Portal account, or otherwise using the Services, you agree to be bound by these Terms.
Where you enter into a credit agreement with us, that agreement — together with your pre-agreement quotation and disclosures — governs the specific terms of your loan. Where anything in these Terms conflicts with your signed credit agreement, the credit agreement takes precedence.
KS Loans is a registered credit provider operating in South Africa under the National Credit Act 34 of 2005 ("the NCA"), with branches in Mahikeng and Rustenburg.
To apply for credit with us you must be at least 18 years old, have legal capacity to enter into a credit agreement, hold a valid South African identity document, and be able to provide the income and residence information we need to assess your application. We do not extend credit to anyone under debt review without following the process required by the NCA.
You may apply online through this website or via our WhatsApp channel. You're responsible for making sure the information you give us — your name, ID number, contact details, income, expenses and the amount you're applying for — is true, accurate and not misleading. Giving us false information may lead to your application being declined, your agreement being cancelled, and may constitute an offence.
Before granting you credit, the NCA requires us to take reasonable steps to assess whether you can afford it, based on the information you give us and information we obtain about your existing debt (for example, from a registered credit bureau). We use an automated affordability calculation as a first, indicative step.
We will not grant you credit if, based on our assessment, we believe you don't have the means to repay it — this is a legal obligation on us (responsible lending), not just a courtesy.
We'll ask you to upload or provide a copy of your ID document, your latest payslip (or other proof of income) and a proof of residence not older than three months. We collect and verify this information to assess affordability and to meet our obligations under the Financial Intelligence Centre Act 38 of 2001 ("FICA") to verify who we're doing business with. See our Privacy Policy for how we handle this information.
Before you sign, we'll give you a pre-agreement statement and quotation setting out the amount, term, interest rate, fees, total cost of credit and repayment schedule, as required by the NCA. Read it carefully — it forms part of your agreement with us. Once you accept and sign, it becomes a binding credit agreement between you and KS Loans.
When you sign your loan application electronically — including drawing your signature on screen — you're giving a legally valid signature under the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), and you agree that your electronic signature has the same legal effect as a handwritten one. We keep a record of your signed agreement and will make a copy available to you on request.
Any interest, initiation fee, monthly service fee and other charges on your loan will never exceed the maximums prescribed by the NCA and the National Credit Regulator ("NCR") from time to time. The exact rate and fees applicable to your loan are set out in your personal pre-agreement quotation and credit agreement — not in these Terms, since they depend on your loan amount, term and risk profile.
Where you authorise a debit order, you're instructing your bank to pay us on the date and for the amount set out in your agreement. You can request a change to your debit order date through the Client Portal or by contacting us — changes take effect from your next billing cycle. You may also dispute an unauthorised or incorrect debit directly with your bank under the debit order dispute rules that apply to all South African bank accounts.
You may settle your loan early, in full or in part, at any time. On request we'll give you a settlement quote. We won't charge an unreasonable early-settlement penalty — any early termination charge will be calculated in line with the NCA.
Section 121 of the NCA gives consumers a right, in certain circumstances, to rescind a credit agreement within 5 business days of signing, without penalty, where the agreement was concluded away from our business premises. Because our online and WhatsApp application channels may fall within this category, we intend to honour this right where it applies.
If you fall behind on your repayments, we'll follow the process required by the NCA before taking further action — including sending you the notice required under section 129, which tells you about your options (including debt counselling) and gives you a chance to resolve the default before we proceed to legal action. You have the right to apply for debt counselling or voluntary debt review under section 86 of the NCA at any time you're struggling to keep up with your obligations.
As required by the NCA, we report your payment behaviour — including late or missed payments — to registered credit bureaus. This affects your credit record and your ability to get credit elsewhere. You're entitled to one free credit report from each registered credit bureau every 12 months, and you can query information you believe is incorrect directly with the bureau.
Your Client Portal account is for your use only. Keep your login details confidential and tell us immediately if you think someone else has accessed your account. We take reasonable steps to keep the Portal secure but can't guarantee it will be uninterrupted or error-free, and we're not liable for losses caused by you sharing your login details or by circumstances outside our reasonable control.
Our WhatsApp channel is a convenient way to apply and get support, but it isn't monitored 24/7 and isn't an appropriate channel for urgent or time-sensitive disputes — use the contact details in section 23 for those. WhatsApp is operated by Meta and your use of it is also subject to WhatsApp's own terms and privacy practices. Standard data or message rates from your mobile network may apply.
The KS Loans name, logo and the content of this website belong to us or our licensors. You may not copy, reproduce or use them without our written permission, other than to use the Services as intended.
We provide the Services with reasonable care and skill, but to the fullest extent permitted by law, we're not liable for indirect or consequential loss arising from your use of the website, WhatsApp channel or Client Portal, except where that loss arises from our gross negligence, wilful misconduct, or as required by the NCA or Consumer Protection Act 68 of 2008. Nothing in these Terms limits any right you have under South African law that cannot lawfully be limited.

We may update these Terms from time to time, for example as we add new services described in our roadmap. We'll post the updated version here with a new "last updated" date. Changes won't affect the terms of a credit agreement you've already signed with us.
These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them, without limiting your right to use the NCR, NFO or Information Regulator complaint processes described in these Terms and our Privacy Policy.
