KS Loans respects your right to privacy. This Privacy Policy explains what personal information we collect through our website, WhatsApp channel and Client Portal, why we collect it, and the rights you have over it under the Protection of Personal Information Act 4 of 2013 ("POPIA"). It applies to applicants, clients, and anyone who contacts us to enquire about our services.
KS Cash Loans (Pty) Ltd (registration number 2019/438529/07), trading as KS Loans, is the "responsible party" under POPIA for the personal information described in this policy. Our registered Information Officer, who oversees our compliance with POPIA, is:

We only collect what we reasonably need to assess, provide, and manage your loan, and to comply with our legal obligations as a credit provider.

Directly from you — when you apply online, apply via WhatsApp, upload documents, use the Client Portal, or contact us. We may also receive information about you from a registered credit bureau (to assess affordability and existing debt) and, where relevant, from a person you've nominated, such as an employer confirming your income.
POPIA requires that we only process your personal information where it's lawful, necessary and adequate for a specific purpose. For most of what we do, that means: it's necessary to enter into and perform your credit agreement, it's required for us to comply with a legal obligation (like FICA or the NCA), or you've given us your consent (for example, to contact you on WhatsApp). Where we rely on your consent, you can withdraw it at any time — though this may affect our ability to continue providing the Services to you.
Our online affordability check is an automated, indicative calculation. In line with section 71 of POPIA, this initial result doesn't by itself decide your loan application — a staff member reviews your application before any final credit decision is made, and you may ask us to explain how an automated assessment was reached or request that a person review it.
Some of our service providers (for example, cloud hosting or WhatsApp/Meta) may process information on servers located outside South Africa. Where this happens, we take reasonable steps to make sure your information receives a similar level of protection to that required under POPIA, including through contractual safeguards with those providers.
We keep your personal information for as long as we need it for the purposes described above, and thereafter for as long as required by law — FICA, for example, generally requires certain records to be kept for at least five years after our business relationship with you ends. After that, we securely delete or anonymise your information, unless we're required or permitted by law to keep it for longer.
We use reasonable technical and organisational measures — such as access controls, encryption where appropriate, and restricting staff access to what they need for their role — to protect your personal information against loss, unauthorised access, and misuse, as required by POPIA's security safeguards condition.

We'll only send you direct marketing (for example, about new products as we roll out our roadmap) if you've opted in, or where the law otherwise allows it. You can opt out at any time, free of charge, by replying "STOP", telling us via WhatsApp, or contacting our Information Officer — we won't charge you and won't make it difficult.
Our Services are intended for adults aged 18 and over, since South African law requires you to be 18 to enter into a credit agreement. We don't knowingly collect personal information from children.
If we become aware of a security compromise that has likely resulted in unauthorised access to or acquisition of your personal information, we'll notify the Information Regulator and you, as required by POPIA, as soon as reasonably possible.
We may update this Privacy Policy from time to time, including as we introduce new services described in our roadmap. We'll post the updated version here with a new "last updated" date.
